1. Acceptance of Terms
By creating an account, accessing the BytesCRM dashboard, or installing a BytesCRM widget on any website, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms presented within the product. If you are using BytesCRM on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree with these Terms, you must not access or use BytesCRM.
2. Account Registration and Responsibilities
To use BytesCRM you must register with a valid email address. You are responsible for:
- Keeping your login credentials secure and confidential.
- All activity that occurs under your account, including actions by any team members you invite.
- Maintaining accurate account and billing information.
- Notifying us promptly at contact@bytescrm.app if you suspect unauthorized access.
- Ensuring your use of BytesCRM complies with all applicable laws, regulations, and third-party rights in your jurisdiction.
3. Acceptable Use
You agree not to use BytesCRM to:
- Send unsolicited, deceptive, or unlawful messages or emails.
- Collect data from website visitors without required notice or legally sufficient consent.
- Impersonate any person, company, or entity.
- Upload, transmit, or distribute malicious code, viruses, or harmful content.
- Attempt unauthorized access to BytesCRM systems, accounts, or infrastructure.
- Circumvent or manipulate subscription limits, quotas, trial periods, or metering.
- Reverse engineer, scrape, or systematically extract data from the BytesCRM application beyond what is provided through official export features.
- Use BytesCRM in any way that violates applicable privacy, data protection, anti-spam, or consumer protection laws.
4. Subscriptions, Plans, and Billing
BytesCRM offers a Free plan and paid subscription tiers. Plans include defined limits for contacts, leads per day and month, team seats, site installations, AI features, analytics access, and support response levels. Details are shown at checkout and on our Pricing page.
- Free plan — Available at no charge and may be modified, limited, or discontinued at any time with reasonable notice where practicable.
- Paid plans — Billed in advance on the cycle shown at checkout. Subscriptions auto-renew unless cancelled before the renewal date.
- Cancellations and refunds — You may cancel at any time. Refund eligibility is governed by the terms presented at checkout and applicable consumer law in your jurisdiction.
- Overages — Exceeding plan limits may restrict functionality (e.g. leads being placed in overflow) rather than incurring automatic additional charges.
5. Customer Content and Data Ownership
You retain ownership of all business data, CRM records, contact information, chatbot knowledge content, and other content you submit to BytesCRM ("Customer Content"). By using BytesCRM, you grant us a limited, non-exclusive, worldwide licence to host, store, process, transmit, and display Customer Content solely as necessary to provide and improve the service.
We will not access, use, or disclose Customer Content except as required to operate and support the service, comply with legal obligations, or as expressly authorized by you.
6. AI-Assisted Features
BytesCRM includes AI-assisted features such as chatbot knowledge generation, lead summaries, email drafting, and conversation assistance. You acknowledge that:
- AI-generated outputs may be incomplete, inaccurate, or unsuitable for your specific context and must be reviewed before use.
- You are responsible for deciding whether AI-generated content is appropriate for your business, customers, and compliance obligations.
- BytesCRM makes no warranty that AI outputs are legally compliant, factually correct, or fit for any particular purpose.
7. Embedded Widget and Third-Party Websites
The BytesCRM widget may be embedded on websites you own or control. As the website operator, you are responsible for:
- Ensuring appropriate disclosure to visitors about chatbot and lead capture functionality.
- Displaying required privacy notices, cookie consent banners, and other legally required disclosures for your site, region, and audience.
- Determining whether the BytesCRM widget consent feature is sufficient for your broader compliance obligations, or whether it must be integrated with a separate consent management platform.
- Compliance with sector-specific regulations (e.g. healthcare, financial services) that may impose additional requirements.
8. Intellectual Property
BytesCRM and all associated software, branding, documentation, and product interfaces are owned by or licensed to BytesCRM. Nothing in these Terms transfers ownership of BytesCRM intellectual property to you. Feedback or suggestions you provide about the product may be used by BytesCRM without restriction or compensation.
9. Service Availability and Changes
We aim to keep BytesCRM available and reliable, but we may update, suspend, limit, or retire features or the service in whole or in part for security, legal, operational, or business reasons. Where we make material changes that affect paid subscribers, we will provide reasonable advance notice where practicable.
10. Disclaimer of Warranties
To the maximum extent permitted by applicable law, BytesCRM is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the service will be error-free, free of security vulnerabilities, or that data will never be lost.
11. Limitation of Liability
To the maximum extent permitted by applicable law, BytesCRM and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use or inability to use the service, even if advised of the possibility of such damages. Where liability cannot be fully excluded, it is limited to the amount paid by you for the service in the twelve months preceding the claim.
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms or BytesCRM shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection law in your jurisdiction provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the product or by email at least 14 days before the changes take effect for active paid subscribers. Continued use of BytesCRM after updated Terms take effect constitutes acceptance.
